UCC § 2-601: Digital Evidence for Discarded Packaging

Overturn discarded packaging denials using the Uniform Commercial Code (UCC) to legally validate your digital photos as proof of loss.

The Uniform Commercial Code (UCC) § 2-601 addresses the buyer's right to reject nonconforming goods — but in the context of carrier claims, it is used to establish the legal validity of digital photographic evidence when physical packaging has been discarded. Carriers routinely demand physical inspection of the damaged packaging as a condition of claim approval. When the packaging has been thrown away, they deny the claim.

UCC § 2-601 and the doctrine of spoliation of evidence create a powerful counter-argument: if the carrier negligently destroyed or failed to retain the packaging during an inspection it had the opportunity to conduct, it cannot later require the shipper to produce that same evidence. Additionally, under the UCC, contemporaneous photographs of the damaged goods constitute valid commercial evidence of the condition of the shipment at the time of delivery.

An effective UCC appeal letter acknowledges that the original packaging is no longer available, argues that the digital photos taken at or near the time of delivery constitute sufficient evidence under the UCC, and contends that any failure to retain the packaging is attributable to the normal behavior of a recipient who had no reason to anticipate that a claim would be denied on physical inspection grounds.
